3.1 Enterprise Software & Fintech Solutions

• The software and fintech services provided by DA Tech Solution are licensed, not sold.
• Users must not modify, reverse-engineer, or resell our software without explicit written consent.

3.2 Industrial Systems & Cross-functional IT Services

• Our IT and industrial technology solutions are custom-built and tailored to specific client needs.
• We retain the right to update, improve, or discontinue any services at our discretion.

3.3 Web Hosting Services

• We provide web hosting, cloud storage, and domain registration subject to availability.
• Clients must ensure their content complies with local and international laws.
• We do not allow hosting of illegal, defamatory, or harmful content.

4. User Responsibilities

By using our services, you agree to:

• Provide accurate and complete information when registering or purchasing services.
• Use our services ethically and legally, without violating intellectual property rights.
• Keep your account credentials secure and notify us immediately of any unauthorized use.

5. Payments and Fees

• Payments must be made as per the agreed contract terms.
• Late payments may result in suspension or termination of services.
• Fees for custom software, IT solutions, and web hosting are non-refundable, except as stated in a specific service agreement.

6. Intellectual Property Rights

• All software, content, and trademarks developed or provided by DA Tech Solution remain our intellectual property.
• Clients retain rights to their own proprietary data hosted or processed through our systems.

7. Privacy and Data Protection

• We collect and process personal data in accordance with our Privacy Policy.
• We implement industry-standard security measures to protect user data.
• Clients are responsible for maintaining the confidentiality of their own customer data.

8. Service Availability and Uptime

• We strive to maintain 99.9% uptime for web hosting and cloud services.
• Scheduled maintenance may cause temporary disruptions, and clients will be notified in advance.
• We are not liable for downtime caused by third-party providers, cyberattacks, or force majeure events.

9. Termination of Services

We reserve the right to suspend or terminate services if:

• Users violate these Terms or engage in unlawful activities.
• There is non-payment of service fees beyond the grace period.
• The business relationship is no longer viable.

10. Limitation of Liability

• DA Tech Solution is not liable for indirect, incidental, or consequential damages arising from the use or inability to use our services.
• Our liability shall not exceed the amount paid by the client for the specific service within the last six months.

11. Dispute Resolution

• Disputes shall first be resolved through negotiation between both parties.
• If unresolved, disputes will be referred to mediation or arbitration in accordance with South Sudanese laws.

12. Changes to Terms

• We reserve the right to update or modify these Terms at any time.
• Continued use of our services after updates constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of South Sudan, and any legal disputes shall be handled within the jurisdiction of South Sudanese courts.
